TERMS OF REFERENCES
for Conferring to a Member of the League Status of the Superintended Representative on Matters of Especial Importance

These Terms of References were developed according to the Statute of IPO ÓInternational League for the Protection of Rights of Ukrainian CitizensÔ, which was approved by the Ministry of Justice of Ukraine, ¦ 1599 from March 22, 2001.
1. THE CHARTER
1.1 ÓInternational League for the Protection of the Rights of Ukrainian CitizensÔ (later referred to as ÓLeagueÔ) is the International Public Organization, which unites on the volunteer basis citizens of Ukraine, foreign citizens, and persons without citizenship for the implementation of general tasks provisioned by LeagueÒs Statute (article 1.1 of the Statute).
1.2. The League submits to the control in all its activities according to the Constitution of Ukraine, current legislation of Ukraine, and legislation of those countries on which territories it serves (article 1.2 of Statute).
1.3. The League is founded and acts on the premise of voluntarism, equity of its members, self-governing, legality, and openness.
2. MEMBERSHIP IN LEAGUE AND CONSIDERATION ON CONFERRING TO THE MEMBER OF THE LEAGUE A STATUS OF ITS REPRESENTATIVE
2.1. Individuals and societies can become members of the League.
2.2. Only individual members of the League may obtain a status of the Superintended Representative on Matters of Especial Importance (later referred to as Ö ÓRepresentativeÔ).
2.3. Individual members may be Ukrainians, foreign citizens, and persons without citizenship who have reached 16 years of age, and who accept the Statute, take part in the fulfillment of tasks of the League, and pay the member fees (article 3.1 of the Statute).
2.4. In order to join the League, individual members must file a written application to the Administration Board of the League, and Administration Board will make a decision for authorization of membership (article 3.2 of the Statute).
2.5. The voluntary separation from the League will be performed on the basis of personal resignation of the individual member with the following consideration of it by the Administration Board of the League (article 3.4 of the Statute).
2.6. The rate of member fees, payment procedure, and the due date will be determined by the Administration Board of the League (article 3.6 of the Statute).
2.7. The procedure of conferring a status of the Superintended Representative will be performed according to the decision of the Administration Board by the virtue of the application and, at least, three petitions of Administration Board staff or of Representatives.
2.8. The consideration of conferring a status of the Representative to a member of the League will be performed during the session of the Administration Board, and decision will be made according to the article 4.10 of the Statute.
2.9. Member of the League, which obtained a status of the Representative, will receive a certificate of a standard pattern.
- ENTRANCE AND CURRENT MEMBER FEES
3.1. According to the article 3.2 of the ÓTerms of References for the Categories of Members of the League and Member FeesÔ of the IPO ÓInternational League for the Protection of Rights of Ukrainian CitizensÔ Representatives divided into the following groups and pay the following member fees:
- citizens of Ukraine:
entrance fee Ö 2000,00 UAH;
current fee Ö 100,00 UAH per month.
- citizens without membership, residents of Ukraine:
entrance fee Ö 2000,00 UAH;
current fee Ö 100,00 UAH per month.
- foreign citizens, citizens of CIS countries, Baltic countries, and persons without citizenship, residents of these countries:
entrance fee Ö 500,00 US dollars according to the NBU course at the time of payment;
current fee Ö 25,00 US dollars per month according to the NBU course at the time of payment.
- foreign citizens, citizens of European, Asian, Africa, North and South America countries, residents of these countries:
entrance fee Ö 1000,00 US dollars according to the NBU course at the time of payment;
current fee Ö 50,00 US dollars per month according to the NBU course at the time of payment.
3.2. Sums of the member fees will be indexed according to the decision of NBU on indexation of money accounts.
4. REPRESENTATIVEÒS OBJECTIVE AND TASKS
4.1. The general objective of RepresentativeÒs activities is the alliance of efforts of LeagueÒs members for the protection of the inalienable human rights and the constitutional rights of Ukrainians and other persons, who are being persecuted for political, racial, religious, or any other reasons, and protection of the common interests of the LeagueÒs members (article 2.1 of the Statute).
4.2. For the purpose of fulfilling of the StatuteÒs tasks, according to the order established by current legislation, the Representative:
- takes part in the international actions to provide human rights protection;
- provides the extension of ideas among the population stated in the Human Rights Declaration, and other documents of the rights protection content (article 2.3 of the Statute).
4.3. The Representative takes part in promotion of the exhibitions, movie- and video-shows, lectures, concerts, seminars, and conferences on the territory of Ukraine as well as abroad.
5. REPRESENTATIVEÒS RIGHTS
The Representative has the following rights:
5.1. To apply to the Department of Law for a legal support for protection of his/her own rights or interests or, by the virtue of his own initiative, the rights and interests of LeagueÒs members in courts, governmental and public bodies of Ukraine on an errand of the League;
5.2. To apply for a legal support to the LeagueÒs Agencies for protection of his/her own rights and interests or, by the virtue of his own initiative, the rights and interests of LeagueÒs members in courts, governmental and public bodies of NIS, Baltic, European, Asian, African, North and South America countries;
5.3. To apply for the legal advice to the Department of Law;
5.4. To apply for service of the Division of Advocates of the Department of Law;
5.5. To apply for service of the Division of Advocates of the Department of Law when the case is considered at the Constitutional, arbitration, and other courts of Ukraine and other countries;
5.6. To command the services offered by the Division of Notary of the Department of Law;
5.7. To appeal personally, in case of a need, to the LeagueÒs Agency at Strasbourg (France) through the Council of Europe and the Court of Europe for Human Rights ;
5.8. To participate in holding the periodic international conferences and seminars dedicated to human rights protection issues, which will be held in Ukraine as well as abroad;
5.9. To participate in Conference sessions;
5.10. To vote for making decisions at Conference sessions;
5.11. To elect and to be elected to the managing bodies of the League.
6. REPRESENTATIVEÒS DUTIES
The representative is obligated:
- to participate in the work;
- to accomplish the errands of managing bodies;
- to facilitate the accomplishment of StatuteÒs tasks;
- to pay member fees in the due time (article 3.8 of the Statute).
7. THE PROCEDURE OF PAYMENT OF ENTRANCE AND CURRENT MEMBER FEES BY THE REPRESENTATIVE
7.1. The Representative will pay current or entrance member fees before 15-th day of every month in cash or cashless form to the current bank account of the League or Representative Office.
7.2. On extraordinary occasions, the Representative may pay the member fees directly to the treasury of the League or Representative Office.
7.3. The Representative may pay the entrance member fees once at a time or in quarters.
7.4. Once at a time member fees will be paid in 3-day period after resolution of the Administration Board session and approval of RepresentativeÒs candidature.
7.5. The entrance and current member fees may be paid in four quarters, first of which will be paid in 3-day term after the approval of RepresentativeÒs candidature by the Administration Board, the following quarters will be paid quarterly.
7.6. The Representative may pay the current member fee once at a time for unlimited period.
7.7. On extraordinary occasions, the term of payment may be changed upon a decision of the Administration Board.
7.8. On extraordinary occasions, the rate of entrance and current member fees may be reduced or raised.
8. FINAL REGULATIONS
8.1. These Terms of References will enter into force after their approval by the Administration Board.
8.2. Amendments and additions to these Terms of References can be fowarded to the consideration of the Administration Board by members of the League, local Agencies, superior and other bodies of the League, and will enter into force after their approval by the Administration Board.
